4AI-Generated Content Disclaimer
The Services utilize artificial intelligence, machine learning technologies, large language models, predictive systems, and automated analytical tools.
You acknowledge and agree that AI-generated outputs may:

- Be incomplete
- Be outdated
- Be misleading
- Include factual errors
- Produce unexpected results
- Misinterpret user inputs

Past performance, examples, case studies, projections, demonstrations, simulations, or recommendations are not guarantees of future results.
6User Responsibilities
You remain solely responsible for:
- Business decisions

- Email campaigns
- Social media content

7Account Registration

Your use of third-party services remains subject to their respective terms and conditions.
10Automations

11Subscriptions and Billing

By subscribing, you authorize Zest to charge your payment method for all applicable fees.
Subscriptions automatically renew unless canceled before the renewal date.
Unless otherwise stated:
- Fees are non-refundable.
- Partial months are not prorated.
- Unused subscription periods are not refundable.
- Failure to pay fees may result in suspension or termination of Services.
Zest reserves the right to modify pricing upon notice.

All rights, title, and interest in and to the Services remain the exclusive property of Zest and its licensors.

- Designs

without Zest's prior written consent.
13Acceptable Use
You agree not to:

- Generate spam
- Harass others
- Disseminate unlawful content
- Misrepresent Zest outputs as guaranteed facts
Zest reserves the right to suspend or terminate accounts violating these provisions.
14Beta Features
The Services may include beta, experimental, preview, or early-access features.
Such features are provided strictly "AS IS" and may:

- Experience downtime
- Produce inaccurate results
- Be discontinued without notice
Zest assumes no liability regarding beta features.
15Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
Zest DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING:

- AVAILABILITY
Zest DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY SECURE.
16Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zest, Launchpoint Dev Inc., DBA Zest, ITS OWNERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Lost profits
- Lost revenue
- Lost business opportunities
- Lost data
- Business interruption
- Reputational harm
- Indirect damages
- Incidental damages
- Consequential damages
- Special damages
- Punitive damages
REGARDLESS OF THE LEGAL THEORY ASSERTED.
17Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zest'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
- (A) ONE HUNDRED U.S. DOLLARS ($100); OR
- (B) THE TOTAL AMOUNT PAID BY YOU TO Zest DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
18Indemnification
You agree to defend, indemnify, and hold harmless Zest, Launchpoint Dev Inc., DBA Zest, its affiliates, officers, directors, employees, contractors, licensors, and agents from any claims, damages, liabilities, losses, costs, expenses, and attorneys' fees arising from:
- Your use of the Services
- Your User Content
- Your business decisions
- Your implementation of Zest recommendations
- Violations of these Terms
- Violations of applicable law
- Third-party claims related to your use of the Services
19Termination
Zest may suspend or terminate access to the Services at any time for any reason, including violations of these Terms.
Upon termination:
- Your access to the Services may cease immediately.
- Outstanding payment obligations remain due.
- Provisions intended to survive termination shall remain in effect.
20Governing Law
These Terms shall be governed by and construed under the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
21Dispute Resolution
Any dispute arising from these Terms or the Services shall be resolved through binding arbitration conducted in the State of Delaware, United States.
You waive any right to:
- Jury trial
- Class action litigation
- Representative proceedings
Claims must be brought individually.
22Force Majeure
Zest shall not be liable for delays or failures caused by events beyond its reasonable control, including:
- Internet outages
- Cloud provider failures
- Cyberattacks
- Government actions
- Natural disasters
- Labor disputes
- Third-party service interruptions
23Modifications to Terms
Zest may modify these Terms at any time.
Updated Terms become effective upon posting.
Continued use of the Services constitutes acceptance of revised Terms.
24Research Use and User Responsibilities
Zest is a tracking and calculation tool for research-oriented peptide workflows. You are responsible for how you use the Services, including verifying calculations, complying with applicable laws, and ensuring that your use is appropriate for your jurisdiction. The Services are not medical advice, diagnosis, or treatment, and do not create a clinician–patient relationship.
